Plan and Review Commission Meeting Minutes
January 3, 2018
The Plan and Review Commission meeting was called to order by Chair Hucker at approximately 6:30 p.m. with Cerman, Mazik, Ross, Hucker, alternate Thearin, and alternate Smith present along with Secretary Tripodi and Zoning Administrator Boss. Thearin will sit as Brandt was absent.
Pledge of Allegiance
Motion made by Mazik and seconded by Cerman approve the 12-6-17 meeting minutes.
Request for Registration of Nonconforming Use as Short Term Rental
The request was made by landowners John Parker and Linda G. Chandler. The Chandlers elected to proceed although it appears that the provisions of the existing zoning ordinance (Part 1 Section 15.10) may not be enforced as it relates to short term rentals at this time. To be “grandfathered” in as a Short-Term Rental there needs to be proof that the property was lawfully running as a Short-Term Rental before the ordinance was adopted on May 10th, 2017. The property is located in an area designated as RR-1. In order to approve the request, the owners need to provide proof that the use was “legally established.” It does not appear that the site was licensed before the ordinance went into effect. The landowner acknowledged that a license was required to offer the property as a short term rental. The owner could not provide the date on which the license was issued. After extensive discussion, a motion was made by Mazik and seconded by Thearin to table all discussion until the February meeting. MC 5-0
Zoning Administrator Report
Boss handed out his monthly report. There was one Shoreland Land Use Permit. One CSM Review, and one Notice of Violation with Order for Corrective Action.
Any Other Business That May Come Before the Commission for Discussion
Comprehensive Plan Update–Hucker handed out the estimated cost proposal from the Northwest Planning Commission. The work will is required for updating statistical data, maps and text to incorporate into the existing plan.
County Public Health Department–He also reported briefly on the Local Emergency Preparedness Committee Meeting held earlier in the day as it related to an anticipated expansion of the County Department of Public Health. Water testing may soon be done in the county rather than outsourcing that work.
Patrick Delaney expressed concern about developments such as that contemplated by the Birke Foundation and that the town should be careful to limit other new development in the forest areas. Hucker noted that the use is consistent with conditional uses for that type of area.
Steve Smith expressed concern about the ability to inspect what the Birkie does at the site. Hucker noted that this is a construction project and what may be approved will not change. Also, the space will be public space.
Mr. Chandler expressed concern that in his case he was forced into short term rental because of the death of this father, his inability to sell the house, the cost of maintenance and the future of the market for housing. It was noted that what he did not like about the effect on his house was one issue but the town also gets numerous complaints about unsupervised renters who cause issues in short term rental.
