Plan and Review Commission Meeting Minutes
February 7, 2018
The Plan and Review Commission meeting was called to order by Chair Hucker at approximately 6:30 p.m. with Cerman, Mazik, Ross, Hucker, Brandt present along with Secretary Tripodi and Zoning Administrator Boss.
Pledge of Allegiance
Motion made by Mazik and seconded by Cerman approve the 1-3-18 meeting and public hearing minutes. MC 5-0
Request for Registration of Nonconforming Use as Short Term Rental
At the request of the applicants John Parker and Linda G. Chandler, the discussion was tabled from the January meeting. The owners elected to proceed although it appears that the provisions of the existing zoning ordinance (Part 1 Section 15.10) may not be enforced as it relates to short-term rentals at this time. To be “grandfathered” in as a Short-Term Rental there needs to be proof that the property was lawfully running as a Short-Term Rental before the ordinance was adopted on May 10th, 2017. The owner provided the date that his license was issued as May 15th, 2017. Which would be 5 days short of the ordinance being adopted.
Motion to deny the request was made by Mazik and seconded by Brandt. MC 4-1
Denial was based on the determination that the use cannot be classified as a legal nonconforming use as a Short-Term Rental based on the evidence that the landowner did not hold a state license as of the effective date of the ordinance. That does not exclude the landowner resubmitting a revised application. The applicant may appeal the discussion to the board of appeals. Zoning Administrator Boss will be issuing the official denial in the form required by Part I Section 15.10 (F)(2).
Zoning Administrator Report
Boss handed out his yearly report. He compared the data for 2017 with past years. He also wanted to review some of the historical data for prior years before the report is finalized.
Discussion Regarding Comprehensive Plan Update
The Town Board approved working with the Northwest Planning Commission to move ahead with the revisions to the town’s Comprehensive Plan. They will be updating all statistical data. Main areas that will need to be revised include population projections and housing development. There will be a public hearing scheduled during the summer months. The current Comprehensive Plan can be found online on the Town of Spider Lake website under Select Town Ordinances.
Any Other Business That May Come Before the Commission for Discussion
There was none.
